Fixed Fee Services

BWP Legal may agree to offer you a fixed fee for certain legal services. 

 

If BWP Legal agrees to offer you a fixed fee for your legal service, it will be detailed in your Costs Agreement, which will set out the scope of service that will be delivered (i.e., what work will be done, and by who), the amount it will cost and what is not included in the service. If you wish to expand the scope of work that is required, it will likely result in additional legal costs.

Magistrate's Court or Children's Court -
Simple Bail Application

It may include:

​

  • a review of the Statement of Material Facts;

  • a detailed letter of advice outlining your prospects on obtaining bail; 

  • liaising with third parties to obtain and/or verify information in support of your bail application (e.g., to confirm a surety, a residential condition etc.); and 

  • attendance at one Court appearance to make the bail application, including travel to/from a Magistrate's Court in the Perth metropolitan area. 

Fixed Fee:    $2,200 + GST

Magistrate's Court or Children's Court - Complex or Sch. 2 Bail Application

It may include:

​

  • what is provided for under a Simple Bail Application; 

  • an additional Court appearance to adjourn a matter, including travel to/from a Magistrate's Court located in the Perth metropolitan area; 

  • liaison with third parties to obtain material to support a bail application (e.g., a doctor's or psychologist report) (if required); 

  • negotiation with prosecution authorities regarding potential bail conditions; 

  • collation of significant additional written material to support a bail application; and 

  • preparation of written submissions for the Court regarding bail. 

Fixed Fee:    $2,750 + GST

Magistrate's Court or Children's Court - 
Simple Plea in Mitigation 

it may include: 

 

  • a review of the Statement of Material Facts; 

  • a detailed letter of advice regarding the elements of the offence, whether the Court can accept the accused's guilty plea, and outlining relevant sentencing factor(s); 

  • liaison with the prosecution if any issues are identified regarding the charges; and 

  • attendance at one Court appearance to deliver a plea in mitigation, including travel to/from a Magistrate's Court located in the Perth metropolitan area. 

Fixed Fee:   $2,200 + GST

Magistrate's Court or Children's Court - 
Complex Plea in Mitigation 

it may include: 

 

  • what is provided for under a Simple Plea in Mitigation;

  • an additional Court appearance to adjourn a matter with a lengthy Court history or order a Pre-Sentence Report or Psychological Report, including travel to/from a Magistrate's Court located in the Perth metropolitan area; 

  • consideration of Pre-Sentence Report or Psychological Report (if required); and

  • preparation of written sentencing submissions for the Court. 

Fixed Fee:  $2,750 + GST

Extraordinary Drivers Licence - Simple

it may include: 

 

  • obtaining Statement of Material Facts, Criminal and Traffic History and review of same; 

  • preparing an Application and a single Affidavit of the person who requires the EDL; and 

  • a Court appearance to present the application, including travel to/from a Magistrate's Court in the Perth metropolitan area. 

Fixed Fee: $2,200 + GST

Extraordinary Drivers Licence - Complex

It may include:

​

  • what is provided for under a Simple EDL Application; 

  • liaison with employers or medical practitioners to obtain additional information to support the application;

  • preparing additional affidavits from an employer, or medical practitioner or specialist, to provide additional supporting material to the Court; and 

  • preparation of written submissions.

Fixed Fee: $2,750 + GST
