Regulatory Investigations and Prosecutions

We provide advice and representation in respect of a wide variety of regulatory investigations and prosecutions.

We are experienced in providing advice regarding anti-corruption investigations and can assist persons or organisations in responding to investigations commenced by the Corruption and Crime Commission and the National Anti-Corruption Commission. 

​

We also can also assist persons or organisations with regulatory prosecutions or civil proceedings that are commenced by the RSPCA, Department of Mines, Industry Regulation and Safety or Local Governments.

Corruption and Crime Commission

​

 

  • Advice regarding responding to an order to produce documents or other things (i.e., a s 95 notice); 

  • Advice regarding responding to a witness summons (i.e., a s 96 summons) and representation at a Commission examination;

  • Making representations on behalf of a person who was examined regarding adverse commentary about them in a parliamentary report (i.e., a s 86 process); 

  • Advice and representation for offences under the Corruption, Crime and Misconduct Act 2003 (e.g., Failure to Comply with a Non-Disclosure Notation, Obstruct Commission Officer, False Testimony, Bribery of a Witness, Destroying Evidence etc.); and 

  • Advice and representation on a contempt of the Commission in the Supreme Court (e.g., Fail to Comply with Notice or Summons, Interrupt an Examination, Fail to be Sworn, Fail to Comply with a Direction etc.)

National Anti-Corruption Commission

  • Advice regarding responding to a notice to produce information or documents (i.e., a s 58 notice); 

  • Advice regarding responding to a witness summons (i.e., a s 63 summons) and representation at a Commission examination; and 

  • Advice regarding making a request for a hearing to proceed in private; 

  • Making submissions on behalf of a person who was examined regarding a critical opinion or finding about them in an investigation report (i.e., a s 153 process); 

  • Advice and representation for offences under the National Anti-Corruption Commission Act 2022 (e.g., Fail to Comply with Non-Disclosure Notation, Failure to Take an Oath or Affirmation, Failure to Answer a Question etc.); and 

  • Advice and representation on a contempt of the Commission in the Supreme Court or Federal Court (e.g., Fail to Appear or Answer a Question, Insults, Disturbs or Disrupts the Commissioner etc.) 

RSPCA

  • Advice regarding search warrants and seizures of animals;

  • Prosecutions for animal cruelty; and 

  • Civil forfeiture applications for animals. 

Department of Mines, Industry Regulation and Safety 

​

  • Prosecutions commenced by WorkSafe or Energy Safety; 

  • Prosecutions and Civil Proceedings brought by Consumer Protection regarding the Australian Consumer Law; and 

  • Advice regarding regulatory proceedings and/or licensing of particular industry groups (e.g., building, plumbing, electricity). 

Local Governments

  • Local Government Act 1995 Prosecutions           

(e.g, Electoral Offences); 

  • Food Act 2008 Prosecutions

(e.g., Handling Food in an Unsafe Manner, False      Description, Sale of Unsafe or Unsuitable Food);

  • Cat Act 2011 Prosecutions

(e.g., Breeding Offences, Requirement to Microchip, Sterilise etc.); 

  • Dog Act 1976 Prosecutions 

(e.g., Dangerous Dogs, Registration Offences, Enforcement Offences); and 

  • Prosecutions and Civil Proceedings related to Breaches of Local Laws.
